Chinese Pharm × Mannings In-Store Promotion Membership Points Program - Terms and Conditions


1. Definitions

  1.1 Company: Refers to Chinese Pharmaceuticals (H.K.) Co., Ltd.

   1.2 Program: Refers to the "Chinese Pharm × Mannings In-Store Promotion Membership Points Program" as described in this document.

  1.3 Member: Refers to any individual who has successfully registered at a Mannings store through the Company's Mannings Promoter Official WhatsApp account and has been issued a membership number.

  1.4 Designated Mannings Stores: Refers to Mannings stores where the Company's promoters are stationed, or other Mannings stores designated by the Company to participate in this Program, as announced on official channels from time to time.

  1.5 Designated Products: Refers to Chinese Pharm products specified by the Company as eligible for points accrual.

  1.6 Promotional Items: Refers to products sold at "Cut-Price Goods" or other promotional prices, and any product categories expressly excluded by the Company.

  1.7 Points: Refers to virtual points earned by Members under this Program in accordance with these Terms and Conditions.

 

2. Effective Date and Eligibility

  2.1 Effective Date: The Program shall take effect upon the Member's completion of registration through the Company's designated channel and issuance of a membership number.

  2.2 Eligibility: Members must be at least 18 years of age and hold a valid Hong Kong Identity Card or other identification documents accepted by the Company. Each valid mobile phone number and email address may be registered only once. Each individual may hold only one membership account.Applicant should use a valid Hong Kong mobile phone for registration, and should be the legal owner of the registered mobile number.

  2.3 Registration Method: Members may register via the Company's official WhatsApp channel. Members must provide true, accurate, and complete personal information and consent to the Company's collection, use, and retention of such information for the purposes of this Program. The Company will not proceed with any application containing incomplete or inaccurate information, and reserves the absolute right to reject any Member application without giving any reason.

 

3. Points Accrual

  3.1 Accrual Basis: Unless otherwise stated, Members shall earn one (1) Point for every HK$100 spent (net of discounts) on Chinese Pharm Designated Products at any Mannings store. Any amount less than HK$100 shall not be eligible for any Point.

  3.2 Exclusions: Points shall not be awarded for the following transactions: purchases of Promotional Items or products excluded by the Company; transactions fully paid by vouchers, points, or other non-cash methods; refund, return, or cancelled transactions; or any transactions suspected of fraud or in breach of these Terms and Conditions.

  3.3 Receipt Submission: Each receipt may be registered only once;if the same transaction is split into multiple payments or submitted with multiple receipts, it shall be processed based on the actual receipts. Members must submit valid transaction receipts from Mannings stores by uploading them via the Company's Mannings Promoter Official WhatsApp account by March 31 of each year. Such spending shall only be valid if incurred at Designated Mannings Stores. Late submissions will not be processed.

 

4. Redemption

  4.1 Redemption Threshold & Rewards: The Company shall specify the rewards available for redemption, such as Mannings cash vouchers, and the required Points, via the Mannings Promoter Official WhatsApp account.

  4.2 Redemption Procedure:Members must visit any Designated Mannings Store to make a purchase and, prior to payment, present the redemption voucher/coupon issued by the Company's Mannings Promoter Official WhatsApp account to the Company's Mannings promoter.The voucher/coupon can be collected and used only after verification by the promoter. Redemption shall be on a first-come, first-served basis, subject to availability of rewards.

  4.3 Restrictions: Gifts, vouchers,or coupons are not exchangeable for cash, resale, or transfer. If a member is found ineligible after redemption, the Company reserves the right to reclaim the gift or invalidate the coupon and seek compensation from the Member.

  4.4 Post-Redemption Handling: If the underlying transaction is cancelled or refunded after redemption, the Member must return the redeemed gift or voucher or coupon, or compensate the Company with equivalent value. The Company reserves the right to recover any outstanding value.


5. Validity and Reversal

  5.1 Validity: Points shall be valid from the date of accrual until March 31 of the following year and shall automatically expire thereafter without replacement.

  5.2 Reversal Mechanism:Points earned from refunded, returned, cancelled, or fraudulent transactions shall be automatically reversed. If such Points have been used for redemption,the Member must return the gift or coupon or compensate the Company with equivalent value.

 

6. Non-Transferability and Restrictions

  6.1 Non-Transferability: Points, redemption rights, and membership accounts are strictly non-transferable and non-assignable.

  6.2 Account Security: Members are responsible for safeguarding their membership account information. The Company shall bear no liability forany loss arising from the Member's failure to properly secure such information.In the event of unauthorized use or any irregularities, Members must immediately notify the Company.

 

7. Employee Participation Restriction

    Internal staff, including but not limited to employees of Chinese Pharmaceuticals (H.K.) Co., Ltd. and Mannings promoters under the Company,shall not register for or participate in this Membership Points Program. If the Company  discovers that any employee or Mannings Promoter has participated in any form, the Company reserves the absolute right to immediately terminate such Member's membership, revoke all accrued Points and redemption rights, without any compensation. Furthermore, the Company reserves the right to recover any outstanding value differences and losses, and to report the matter to the relevant authorities.

 

8. Refunds, Returns and Disputes

  8.1 Refund Impact: In the event of any refund or return resulting in a change to the transaction amount, the corresponding Points shall be automatically adjusted or reversed in accordance with the Company's system records.

  8.2 Dispute Resolution Procedure: If a Member disputes any Points, redemption, or other matters,the Member shall submit a written or electronic complaint to the Company within thirty (30) days of becoming aware of the issue, together with supporting documentation. The Company shall investigate within a reasonable time and respond in writing or electronically.

  8.3 Final Decision: If a dispute remains unresolved after investigation, the Company reserves the right of final decision. In the event of judicial proceedings, both parties agree to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

 

9. Amendment, Suspension and Termination

  9.1 Right of Amendment: The Company reserves the right to amend, suspend, or terminate the Program and these Terms and Conditions at any time. Any amendments shall take effect upon publication through the Company's official channels. The Company shall, under reasonable circumstances, clarify whether accrued Points are affected.

  9.2 Right of Termination: If the Company terminates the Program, Members shall be notified in a reasonable manner prior to termination, together with an explanation of how Points will be handled. Termination shall not affect any rights accrued by the Company prior to termination.

 

10. Privacy and Personal Data

   10.1 Use of Data: The personal data provided by Members shall be used solely for the operation and management of membership accounts. For detailed information on how the Company uses personal data in connection with your membership, please refer to the Company's Privacy Policy.

   10.2 Member Contact Information: Members must provide up-to-date contact details, including a current email address and telephone number, to ensure that all communications relating to this Program are sent to the correct address. In the event of any changes to contact information, Members must promptly notify the Company. The Company shall not be liable for any potential or actual loss, claim, or damage,whether direct or indirect, arising from the absence of accurate and updated contact information provided by Members.

   10.3 Data Security: The Company shall adopt reasonable technical and administrative measures to safeguard Members' personal data. The Company shall not be liable for any data leakage caused by Members' own negligence or third-party actions beyond the Company's control. Members may exercise rights of access, correction, or deletion of personal data in accordance with the Company's Privacy Policy.


11. Liability Limitation

    Except as otherwise required by law, the Company shall not be liable for any direct, indirect, special, consequential or punitive damages arising from the Program, system failures, force majeure events, or third-party actions.


12. Breach and Remedies

   12.1 Breach Handling: If a Member breaches these Terms and Conditions, the Company may suspend or terminate membership, revoke Points, cancel redemption rights, and pursue other legal remedies.

   12.2 Fraudulent Conduct: If a Member is found to have engaged in fraudulent conduct, including falsifying receipts, duplicate registrations, impersonation, or other fraudulent acts, the Company may recover losses and report the matter to relevant authorities.

   12.3 Membership Termination:Members may terminate their membership at any time by providing written notice to the Company. Upon termination of membership, all unused points, gifts,vouchers, or coupons shall be cancelled and rendered void.

 

13. Governing Law and Jurisdiction

   13.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

   13.2 Jurisdiction: Both parties agree to submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

 

14. Effective Language and Severability

   14.1 Language Versions:These Terms and Conditions are prepared in both Chinese and English. In the event of any inconsistency, the Chinese version shall prevail.

   14.2 Severability: If any provision herein is held invalid or unenforceable by a court of competent jurisdiction,such provision shall be severed to the extent necessary without affecting the validity or enforce ability of the remaining provisions.

 

15. Contact and Acceptance

   15.1 Inquiries and Complaints: Members with inquiries or complaints shall contact the Company's Customer Service Department via the official WhatsApp channel.

   15.2 Acceptance of Terms: By completing registration and using the Member account or participating in the Program, Members shall be deemed to have read, understood, and agreed to be legally bound by these Terms and Conditions, including any amended versions published by the Company.
